This document contains guidelines regarding the collection, use, disclosure, and any type of processing of personal data from Users of the services provided by Living Metrics SpA (hereinafter, "Living Metrics"), through the platform (hereinafter, "Privacy Policy").

1. Authorization for Processing

1. By clicking the checkbox, you expressly authorize and give your consent for Living Metrics to process your personal data in order to provide a better experience to the User on the Platform and offer the Products and Services indicated therein.

 

By registering on the platform, the User expressly authorizes Living Metrics to process their personal data in accordance with the purposes described below, and in compliance with Law 19.628 on the Protection of Private Life.

According to Law 19.628 on the Protection of Private Life, the term "personal data" is defined as information concerning natural persons, identified or identifiable, and the processing of such personal data is subject to the provisions of said Law.

In the event that the User does not wish their personal data to be subject to the processing described in these Privacy Policies, they must refrain from using the Living Metrics Platform, as this information is essential to provide the benefits and proper use of the Platform.

Acceptance of the Terms and Conditions, as well as the Privacy Policies described below, is a requirement for purchasing and using the Living Metrics platform and constitutes a contract between any User, registered or not, and Living Metrics

2. Nature and Use of Personal

Data When registering on the platform and during the provision of services, Living Metrics collects the following data from Users: names, surnames, email address, mobile phone number or other, internet connection IP, location, and other similar data that may be required to safely, timely, and correctly provide Services and Products.

In some cases, Users may be asked for certain personal data to improve and personalize the Services and marketing campaigns of the Products. For the same reason, we may complement the personal information provided by the User with publicly available information and information available from other sources to the extent permitted by applicable law.

It is presumed that the data has been provided by its owner or by a person authorized by them, and that it is correct, complete, current, and accurate. In case of any change in their personal information, the User is responsible for updating it promptly.

Living Metrics is not responsible for the use that third parties make of the information published or contained on the platform.

3. Purposes of Data Processing

The personal data of Users are used for the following purposes related to the Services and Products:

Likewise, Living Metrics may always communicate the personal data of Users to third parties when access or use of such information is necessary for the following purposes:

    b) Ensuring compliance with the Terms and Conditions and this Privacy Policy, including the investigation of potential breaches of these.

    d) Protecting against any harm to the rights, property, or safety of Living Metrics and its Users, as required or permitted by applicable law.

4. Communication of Personal Data

For the provision of Services, sale, and delivery of Products, Living Metrics may hire other companies or providers (hereinafter, the "Providers") to assist in whatever is necessary to comply with the above in accordance with the purposes described above. In this sense, Living Metrics may hire service providers for marketing, communications, infrastructure, and IT services, which may customize and improve their Services and Platform, process credit card transactions, provide customer service, analyze data, including information regarding User interaction with the Platform, and process consumer surveys.

To provide their services, Providers may have access to Users' personal data and are obligated to use and process the data exclusively for the purposes for which they were transferred, and in accordance with what is established in this Privacy Policy. It is strictly prohibited for Providers to use, disclose, or otherwise process personal data for any purpose other than that for which they were transferred and authorized by this Privacy Policy, except with the express consent of Users.

The User expressly authorizes the communication of their data outside their country of residence to any country where Living Metrics has facilities or activities with Providers. The countries to which personal data are transmitted may have a less comprehensive level of data protection than that of our country, which is accepted by the User subscribing to this Privacy Policy.

In the event that Living Metrics undergoes reorganization, restructuring, merger, sale, or any other transfer of assets, it reserves the right to transfer information, including the personal data of its Users, provided that the recipient agrees to process such personal data in accordance with this Privacy Policy.

5. Third-Party Services

 

As mentioned, Living Metrics may contract additional services provided by third parties, in which case they may collect and process User data during the use and interaction with the Platform. In this case, the User is solely responsible for reviewing the terms and conditions and privacy policies of such third parties, and Living Metrics is not responsible for their information handling practices.

6. Information Security

 

Living Metrics employs administrative, technical, physical, and managerial measures necessary for the security and confidentiality of information, especially the personal data of Users. Nevertheless, no security system is infallible, so it is not possible to guarantee the security or confidentiality of the information.

Due to this, Living Metrics will not assume any responsibility for cases of security breaches or unauthorized access caused by malicious attacks or the use of tools intended to fraudulently obtain Users' personal data.

It is also the User's responsibility to protect the confidentiality of the access information to their account, restrict access to the computer or device used to access their account, and take basic measures to prevent unauthorized access to their account, such as logging out after using the platform on a public or shared device, using secure passwords, among others.

The User expressly consents to be notified of any breach or unauthorized access to their personal data that may occur during the use of the Platform and the offered Products and Services.

7. User Rights

 

Living Metrics guarantees Users the free exercise of their rights to information, modification, cancellation, and blocking of their personal data, as established in Law 19.628.

Users may make requests related to these rights by sending an email to felipe@livingmetrics.tech, Living Metrics will seek to respond to the request as quickly as possible.

8 Cookies and Internet Advertising

 

The User accepts that Living Metrics and its Providers use cookies and other technologies (such as web beacons), which are used for various purposes: to facilitate access to the Platform and Products and Services; to provide these more efficiently; to better understand the interests of Users; and to carry out marketing or advertising.

9. Changes to the Privacy Policy

 

We reserve the right to modify the Privacy Policy at any time, with changes taking effect immediately upon publication on the Platform.

Notwithstanding the above, if changes pertain to substantial aspects that were considered at the time of obtaining consent, such as the purposes of processing, they will be notified to the User by electronic means, using the contact information provided by the User, and their consent will be requested again for the processing of their data. If the User does not provide consent again, and the changes are necessary for the provision of Services, it will be understood that the User does not wish to continue using the Services.

Users who do not agree with the Privacy Policy or the aforementioned changes may withdraw their consent at any time.
